What is a Declaration?

A Declaration is a fundamental legal document widely used in South African legal and business practice. This document type is essential when individuals or organizations need to formally affirm facts, intentions, or circumstances under oath. Declarations are commonly required for various purposes, including legal proceedings, administrative applications, business transactions, and regulatory compliance. The document must be executed in accordance with South African law, particularly the Justices of the Peace and Commissioners of Oaths Act, which requires certification by a Commissioner of Oaths. Declarations can contain various types of information, from personal statements to business facts, and carry serious legal implications if found to contain false information.

What sections should be included in a Declaration?

1. Declarant Details: Full legal name, identity number, and address of the person making the declaration

2. Capacity Statement: Statement of the declarant's capacity or authority to make the declaration

3. Declaration Content: The main substance of the declaration, clearly numbered and organized in paragraphs

4. Truth Attestation: Standard attestation that the contents are true and correct to the best of the declarant's knowledge

5. Signature Block: Space for declarant's signature, date, and place of signing

6. Commissioner of Oaths Certification: Official certification by the Commissioner of Oaths, including their details and stamp

What sections are optional to include in a Declaration?

1. Supporting References: References to supporting documents or evidence, used when the declaration relies on specific documents or records

2. Witness Details: Details of additional witnesses, used when additional verification is required beyond the Commissioner of Oaths

3. Translator Certification: Required when the declaration is made in a language other than the declarant's first language

4. Prior Declarations: References to any previous declarations on the same matter, used when this declaration supplements or updates earlier ones

What schedules should be included in a Declaration?

1. Annexure A - Supporting Documents: Copies of referenced documents or evidence mentioned in the declaration

2. Annexure B - Identity Documentation: Copies of identity documents or authority documentation where required

3. Annexure C - Additional Statements: Any supplementary statements or information that support the main declaration
